Reselling products purchased from our ecommerce shop for commercial purposes, other than through authorized wholesale channels, is strictly prohibited. We reserve the right to investigate and take appropriate action against any user found in violation of this policy, including but not limited to suspending or terminating your account, canceling orders, and pursuing legal action if necessary.

SECTION 11 - EXCHANGES AND REFUNDS

REFUND POLICY
Definitions/Concepts:

Return for Refund: A "return for refund" refers to the process by which a customer returns a product, and upon successful evaluation, a refund is issued to the original payment method used for the purchase.

Exchange: An "exchange" is the process by which a customer returns a product and, upon successful evaluation, receives a store credit in the form of a discount code that can be used for future purchases on the site. This store credit does not expire and allows the customer to shop again on the site using the provided discount code.

If the customer is not completely satisfied with your order, initiate a return or exchange by emailing hello@livelifepurely.com.

Upon providing you with the return address within the initial 30-day return/exchange period, please ensure the return of your items within seven (7) working days. Items returned after this seven-day timeframe will not qualify for an exchange or refund.

Shipping Costs
When returning an item for a refund to the original payment method, you will be responsible for covering the shipping fees for sending the item(s) back to us. However, if you opt for an exchange, we will cover the shipping costs to dispatch the new item(s) to you.

Processing Time
Upon receiving your package at our facility, there will be a processing period of a few business days (Monday to Friday). In rare cases, this process may take up to 14 days. During this period, our team will verify and account for the items you have returned. Once we receive confirmation from our warehouse, we will contact you via email to acknowledge the receipt of your return and finalize the process.

PRODUCT WARRANTY

30-Day Warranty Coverage

All items are covered by a 30-day warranty. During this period, customers may request a full refund, replacement, or exchange for their items. If a defective item needs to be returned, Gutable will provide a prepaid shipping label for exchanges or store credit.

Handling of Issues

In the event of a broken item upon delivery, the customer must notify Gutable within 48 hours of the delivery date. Please attach a picture displaying the issue(s) and provide a description for our records.

Missing Item Resolution

If an item is missing from the package, customers should inform Gutable within 48 hours of the expected delivery date. Gutable may provide a discount code for the missing item's value (with USA shipping covered) or refund the item's value.

Non-Receipt of Package

If tracking confirms delivery but the customer has not received the package, please contact Gutable. If the package is en route back due to an address error not on our end, Gutable will cover the USA re-shipment (at a rate of 4.99 USD) once per year per customer. Multiple address errors will be addressed on a case-by-case basis.

Gutable strives to maintain fairness and integrity in its policies. Therefore, if Gutable determines that a customer is taking unfair advantage of its policy provisions, Gutable reserves the right to discontinue this courtesy for that specific customer.

FINAL SALE ITEMS

To qualify for a refund or exchange, items must be full-sized, with at least 90 percent of the product remaining. Refunds cannot be honored for items that are broken, defective, or more than 90 percent used. Certain items are considered final sales and are not eligible for return, exchange, or refund. These items include the following:

  • Personalized Products: Any product that has been customized or personalized to your specific requirements.
  • Sample Sizes: Products offered in sample or trial sizes.
  • Lab Tests: Products or services related to lab tests or diagnostic services.
  • Products Marked 'Final Sale': Items specifically labeled as 'final sale' at the time of purchase.
  • Gift Cards: All gift card purchases are considered final and non-refundable.
  • Digitally Downloaded Products: This category includes products such as ebooks and digital content, which are not eligible for return.

Please carefully consider these factors before making a purchase decision, as these items are not subject to our standard return and refund policies.

Refund and Return Limitations
Refunds for eligible orders are limited to a maximum of $300 per order. This means that if you qualify for a refund, the total refund amount will not exceed $300. This limitation is in place to ensure fair and consistent processing of refunds while maintaining the quality of our service.

Customer Order Returns Limitation
To provide an efficient and streamlined shopping experience, we also impose a reasonable limitation on customer order returns. Each customer is allowed a maximum of two returns or exchanges per calendar month. This limitation is designed to strike a balance between accommodating customer needs and preventing abuse of our return policy. SECTION 14 - DISPUTE RESOLUTION, MANDATORY MEDIATION, AND BINDING ARBITRATION AGREEMENT

You and Gutable agree that we will resolve any disputes between us through a mandatory three-step process: (1) informal negotiation, (2) mandatory mediation, and (3) binding arbitration. You and Gutable hereby waive any right to a jury trial or court proceedings for any Claim, except as expressly provided herein.

Informal Negotiation

Before initiating any formal dispute resolution process, you agree to first contact Gutable with a description of your complaint or concern, and allow us 30 days to respond and attempt to resolve the issue informally.

Mandatory Mediation

If informal negotiation does not resolve the dispute, you and Gutable agree to participate in mandatory mediation before a mutually agreed-upon mediator. The mediation shall be conducted in accordance with the American Arbitration Association (AAA) Mediation Procedures. The costs of mediation shall be shared equally between the parties.

Binding Arbitration

If mediation does not resolve the dispute, all controversies, claims, counterclaims, or other disputes arising between you and Gutable relating to these Terms of Service or the Website (each a "Claim") shall be submitted for binding arbitration in accordance with the Federal Arbitration Act and the Rules of the American Arbitration Association ("AAA Rules"). The arbitration will be heard and determined by a single arbitrator. The arbitrator's decision in any such arbitration will be final and binding upon the parties and may be enforced in any court of competent jurisdiction. The parties agree that the arbitration will be kept confidential to the extent permitted by law.

Arbitration Costs: You will be responsible for an initial filing fee of $250, which will be refunded if you prevail in the arbitration. If you demonstrate that the remaining costs of arbitration will be prohibitive as compared to the costs of litigation, Gutable will contribute up to a maximum of $1,000 towards the administrative costs and arbitrator's fees required for the arbitration. The arbitrator may reallocate the costs of arbitration in the final award if they determine that your claim was frivolous or brought in bad faith. In the final award, the arbitrator may apportion the costs of arbitration and the compensation of the arbitrator among the parties in such amounts as the arbitrator deems appropriate, subject to the limitations described in this paragraph.

This agreement to arbitrate does not preclude you or Gutable from seeking action by federal, state, or local government agencies. You and Gutable also have the right to bring qualifying claims in small claims court. In addition, you and Gutable retain the right to apply to any court of competent jurisdiction for provisional relief, including pre-arbitral attachments or preliminary injunctions, and any such request shall not be deemed incompatible with these Terms of Service, nor a waiver of the right to have disputes submitted to arbitration as provided in these Terms of Service.

Neither you nor Gutable may act as a class representative or private attorney general, nor participate as a member of a class of claimants, with respect to any Claim. Claims may not be arbitrated on a class or representative basis. The arbitrator can decide only your and Gutable's individual Claims. The arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated.

If any provision of this Section is found to be invalid or unenforceable, then that specific provision shall be of no force and effect and shall be severed, but the remainder of this Section shall continue in full force and effect. No waiver of any provision of this Section of the Terms of Service will be effective or enforceable unless recorded in a writing signed by the party waiving such a right or requirement. Such a waiver shall not waive or affect any other portion of this Terms of Service. This Section of the Terms of Service will survive the termination of your relationship with Gutable.

THIS SECTION LIMITS CERTAIN RIGHTS, INCLUDING THE RIGHT TO MAINTAIN A COURT ACTION, THE RIGHT TO A JURY TRIAL, THE RIGHT TO PARTICIPATE IN ANY FORM OF CLASS OR REPRESENTATIVE CLAIM, THE RIGHT TO ENGAGE IN DISCOVERY EXCEPT AS PROVIDED IN AAA RULES, AND THE RIGHT TO CERTAIN REMEDIES AND FORMS OF RELIEF. OTHER RIGHTS THAT YOU OR GUTABLE WOULD HAVE IN COURT ALSO MAY NOT BE AVAILABLE IN ARBITRATION.

Opt-Out Right: You have the right to opt out and not be bound by the arbitration and class action waiver provisions set forth in this Agreement by sending written notice of your decision to opt out to the following address: Gutable, LLC, 20540 State Highway 46 W Ste 115 # 449, Spring Branch, TX 78070, United States. The notice must be sent within 30 days of your first use of the Gutable service or website, whichever is earlier. If you opt out of the arbitration agreement, Gutable will not be bound by it either.

By using Gutable's services or website, you acknowledge that you have read and understood this agreement and agree to be bound by its terms. If you do not agree to these terms, you must not use Gutable's services or website.

SECTION 15 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.

You agree that from time to time we may remove the Service for indefinite periods of time or cancel the Service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the Service is at your sole risk. In no case shall Gutable, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, Service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the Service or any products procured using the Service, or for any other claim related in any way to your use of the Service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Gutable and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 17 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 18 - TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 19 - ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
